1. If yes, why doesnt apple do it themselves; or take an agreement from the user that their devices shouldnt be used for whats not intended.

But isnt violating the EULA itself illegal once we have bought the stuff from them. Also, isnt jailbreaking like some kinda modification/reverse engineering which infringes certain copyrights that protect various portions of the closed-source iPhone OS? And hence Illegal and liable to legal action if caught?
