Yes one should surely look out for the rating of the seller on ebay before buying something.
But here the case is different, we are talking about warranty and seller has already listed that it doesn't carry manufacturer warranty so if any problem comes in your phone you need to send the phone(courier it) to the seller and then he will repair or do whatever is necessary, the company will not be responsible for anything.
So if you are comfortable with that then go for it.
