Should minimum wage be by hour or by month?

Hi all,

I just checked today that the minimum wage in India is set by month and by day rather than by hour in many so called developed countries. Moreover, its different in each state.

I have come to question this and thought it would make for good discussion here considering there are so many techies here and the tech industry is apparently booming in India.

What do you think?

1) Should the minimum wage be set by hour or as is currently or someway else? And why?

2) Should the minimum wage be the same in every state enforced by the central government or as is currently or someway else? And why?

It should be by hour, currently its very very low here, earning minimum wage in India is equivalent to spending nights in road and eating from community kitchens, forget medications etc. The reason it should be by hour is no company follows the hour rule here, from lowest paid employees to highest paid analysts all work extra, all the time, we have to.

" no company follows the hour rule here" - True that! I received my first work contract here in India and my hours were not even mentioned on the contract. Is this against the law?

AFAIK, nope, it's like that everywhere here. :(
It should definitely be by hour, i have roommates, who work for like 12-16hrs a day for most of their working days, and gets paid for the official time only, which is the standard 8 hrs., that's pure exploitation and it needs to stop.

Actually daily wage workers won't work past their working hour even for a minute. they have a set daily wage.

no one is professional here
we need proper policies for extra time also

I hardly work for 8 hrs daily. but we bill the client for the hours we spend.
most software related projects are billed per hour, also I believe Call centers do the same.
its another matter that we may have to extend working hours if deadline is not met. but those can be avoided if people actually work and not procrastinate.

some workplaces in US have a no crunch policy
My ex class mates from college all work in media industry - mostly advertising and journalism, some are in production houses. Most of them are made to stay back after hours for meeting deadlines, and none of them are paid overtime for that.
In fact, no one keeps track of how many hours in a month they work.

Actually the factory act says that a worker can work for 48 hours a week in the wage paid by the company. Else the company will have to pay extra. And there is a limit to maximum hours also. One can't work beyond 16 hrs a day and 9 days a week without off day

Does it specify how long is a 'week'? If its 7 days, thats 7 hours EVERYDAY!

Maybe they should keep a track. Might be quite illuminating. And what's a no crunch policy?

Are you in the software industry in India? If you dont mind me asking, what's your position? And how's it like working in this industry at your position in India?

I think you should tell them to start tracking their hours and start saving up for a lawyer. ;)

Yes I am. I am have worked as a SSE, Tech Lead, Module Lead etc. currently serving as a SSE. my company is a small one with 150+ members, 90% are dev. In India, other than a big multinational company the roles of Team Lead means you got code too + meetings and other stuff. My team lead heads 3 - 4 projects with 15 people, but his designations is still SSE.

Trainee -> Junior Programmer (Jr. Dev) -> Programmer (dev / Software Engineer) -> Sr Programmer ( Senior Software Engineer ) -> Module Lead -> Tech Lead (Team Lead/Project Lead) -> Jr. Project Manager -> Project Manager ................

Tech Lead is a guy who is expected to lead a team based on his technical knowledge but may not know how to handle a team.
Team Lead is a guy who knows how to handle a team but may now know how to give solutions for a technical problem. and they are good at MS Excel.

Module lead is a guy who handles a smaller team inside a bigger team and handles only few features of the product being developed.

also the designation is based on total experience and relevant experience.
