Australian court rules an Indian is culturally predisposed to be a creepy stalker

Sandesh Baliga stalked one woman for 18 months and another for four months in 2012 and 2013.

The 32-year-old security guard maintained Bollywood movies contributed to his belief a woman would eventually fall in love with a man if he pursued her enough.

Baliga came to Tasmania from India to study accounting about three years ago.

The court heard Baliga texted, called and approached the women excessively, and had begun referring to himself as their boyfriend.

Hobart magistrate Michael Hill agreed Baliga's cultural background helped explain why he did not appreciate the seriousness of his actions.

His lawyer Greg Barns told the court it was "quite normal behaviour" for Indian men to pursue women in a similar way and Baliga did not realise his actions could be classed as criminal.

Mr Hill adjourned the complaint without conviction for five years on the condition Baliga was of good behaviour over that period.

He said the charges were serious but "after anxious consideration" he believed recording a conviction would affect Baliga's job prospects.

The magistrate added that Baliga was remorseful and there was a low risk of reoffending, and his guilty plea had spared the women the stress of giving evidence.

A character witness told the court Baliga acknowledged alcohol had contributed to his action and had stopped drinking.

Baliga did not object to restraint orders being imposed.

That bloody sucker. He's making all Indians look bad.

I don't agree that all Indians have a similar mindset, but its true that majority of Indians are exceedingly gullible. Therefore, the influence of Bollywood on this guy is somewhat understandable.

But Bollywood is also to blame since this is exactly the subject matter of 99% of the films. Couple that with gullibility and people's mindset is shaped into that.

The truth is far from it. Generally, those students who seek employment after higher studies in foreign countries, have a lot of pressure on them to perform (Given that they spend upwards of 20 lacs). They work hard, are extremely frugal and most importantly, try to gel in with the people there to increase their network and consequently, chances of securing a job.

Ok. His actions are creepy, i understood. Where does the culture comes here?
Any person with the same mind, could do that.

But this guy is to blame first. Following a girl for 18 months?
With the r@pes happening in our country, especially involving foreign women - I wonder how much pressure the girls ( i dont care whether they're Indian or Australian) were in..

The culture comes in as he was let off without the regular punishment a local would have got for doing the same thing... because he was an Indian

his lawyer told the court this is how the men in India are, and the judge accepted that argument

Interesting read. Proves that our standards for racism is different than rest of the world.

While in the rest of the world its based on ethnicity, here its based on caste.
