Issue with an ebay bought phone. Need help

Hey guys,
I ordered an Xperia Tipo phone(for my dad) from ebay. I received the item. However, the seller has shipped the item intended for promotion. The box clearly states 'Item is for promotion. Not intended for retail sale'. I tried to call the seller. But all 3 numbers provided by him were unreachable. That's why I have posted a message through the resolution centre of ebay under the 'product is not as described' section and have messaged him. I want complete refund for the item. I do not trust him with a replacement as the invoice provided by him doesn't even have the authorised signature. I have not opened the box yet. Is there anything else that needs to be done to ensure that I will get complete refund? Thanks in advance..

its a big pain to replacement from ebay unless hes a power seller..all the best...

Thanks. He's a power seller. Also, it's against ebay rules to sell promotional items. He may even lose the power seller status for doing so. So, i hope i can get through this quickly.

Call Ebay customer helpline and directly talk to their customer care... Its faster than email...

I had stopped trusting Ebay a long time ago when one seller sent me a defective Sennheiser headset. Tried to get it replaced... sent it back, and after a month, that seller sent me the same headset again... Total loss... Ebay did not do much to help...

So, its better to go for a refund...

Call Ebay customer helpline and directly talk to their customer care... Its faster than email...

I had stopped trusting Ebay a long time ago when one seller sent me a defective Sennheiser headset. Tried to get it replaced... sent it back, and after a month, that seller sent me the same headset again... Total loss... Ebay did not do much to help...

So, its better to go for a refund...

Thanks to both of you guys' support and advice:). I have messaged the seller and have informed him to reply by tomorrow before deciding anything else. I have also mentioned it clearly to him that I am not interested in replacement as I don't feel secure enough about the transaction anymore and that I need complete refund. Is it better to send him the product and trust him with refund or shall I call the eBay customer care directly and get the refund the hard way? I'm planning on waiting to get his reply before proceeding. What to do?

Call the ebay CC; better to be safe rather regret.

Wait for Ebay CC to contact you and ask you to send it back.

I had once bought a replacement battery for my laptop from ebay. Turned out it was defective. Had to wait a while to send it back.

Ebay refunded the entire amount as well as sent a cheque for the cost of courier to send the item back to the seller...

So, sometimes, Ebay CC is very helpful...

I'm hoping that it'll be solved soon. I don't want my headache to be transferred to my dad :)

Hey guys, I contacted the ebay customer care through call center. He suggested me to wait for a week from payment date and file a claim through 'eBay Guarantee'. However ebay guarantee doesn't speak anywhere about the need to wait for a week. I'm thinking of filing the complaint ASAP. What to do?

Update: I posted a claim as there was no mention of waiting for a week.

Hey guys, here's the update.

-After placing a claim on eBay guarantee on 8 Nov, I got a confirmation call on 9th that my claim had been registered and that I'd get an actual call within 48 hours regarding the issue.

-Didn't hear anything from them. So, called them up on 16th of Nov. The guy said that the claim is under progress and that I'd get a call within 24 hours. No sign of them yet.

Didn't know eBay's support was such a PITA. So, help me guys. What should I do now? I'll call them up again and again everyday till it gets done from now. Is there anything else that can be done to speed this up?

don't worry . u get refund + ship charge from ebay . only u need to claim it . it take time though . max 1 month

I think, it will make you appear buggy on eBay CC. Let'em process the claim.
I got my refund back in 15 days, for a product that was ordered but found defective.

ebay will call you after some days . then they will directly call seller and try to resolve issue . they will also call you and tell you necessary step you need to take to get your money back or get new product . they will also give you coupons for future use equal to courier charge you pay to ship the product .

Don't worry mate you will get the refund. I get my refund which was in Pound and get in Rupee, just keep calling them and say you will file RTI then they have to answer you in 15 days.

The 'Promotional Material. Not for Sale' sticker was for the 2 lucky draw Diwali offer coupons from Sony shipped along with the phone. The phone itself is legal. That was so stupid of me to think that the phone itself was a promotional piece ;)
The seller has some fault too. If he had replied when I had messaged him, this would not have come till this:)
