The judge has ruled that Android 2.x violates Apple's 868 patent which covers scrolling through photos on a touchscreen. Only this one patent is violated - the complaints about two other patents as well as the design patents has been thrown out. In other words, the judge did not agree with Apple that Samsung is copying Apple's design.

In fact, only the Gallery application violates the patent in question, and Samsung has already stated it is going to replace this application on all new Galaxy smartphones from now on - sales won't even be interrupted. In other words - two patents thrown out, design stuff rejected, and only one patent complaint upheld which will cause no harm to Samsung. Apple just scored a meaningless victory.

Update : The judge prohibited the marketing of Samsung smartphones Galaxy S, SII and Ace EP 2058868 for violation of Apple. The judge waives all claims based on the two other patents, design rights, copyrights and slavish (style) imitation.

Samsung is infringing on Apple's patent on scrolling through a photo gallery using finger gestures on a touch screen. There is no infringement of the other two patents, and copying the design is not there, set right.


means currently the ban imposed on SGS , SGS 2 and Ace is because of software patents which Samsung can remove by just pushing an update which removes the gallery app and replace it with new UI.

The infringement applies only to Samsung's smartphones running Android 2.3.

Android 3.x, that runs on the tablet does not infringe.

yeah..i am very happy for Samsung.

I dont understand how one can have patent on rectangle..glad that judge rules it in favour of Samsung..


speaking about software issues. those can be addressed with OS update..


may be samsung will push ICS update to SGS , SGS II and Ace

The devices only seem to infringe on software aspects, in this case the standard Google Android gallery. This, it seems that Apple has less powder to shoot than previously thought.

OS news points to evidence showing that although Apple entered into battle with three patents and a community design, all but the Gallery patent were thrown out by the judge.

The swipe-to-unlock patent will likely be declared invalid, the judge wrote, specifically referring to the Neonode N1m mobile phone as prior art, which has the exact same unlock method as the Iphone.

Apple's complaint about the design of Galaxy smartphones was also thrown out, with the judge citing numerous cases of prior art, including the LG Prada.

It is amazing to know the Technical knowledge of Duch court Judge is amazing and reasonable unlike his German counterpart..
Now samsung has time to remove the offending application,by using android update..
this is the first time that Prada's design come to judicial decision, Apple heavily laid its case on 'itsso called design patents.. Now it is the LG 's turn to sue Apple..we hope sanity will return and each party counter licesensed, live and let live everyone..
