While we are congratulating ourselves for SOPA defeat, now it is returned with another 'avatar' ACTA (Anti-Counterfeiting Trade Agreement)
Some are characterizing ACTA as worse than SOPA, but the reality is somewhat more complicated. From a substantive perspective, ACTA's Internet provisions are plainly not as bad as those contemplated by SOPA. Over the course of several years of public protest and pressure, the Internet provisions were gradually watered down with the removal of three strikes and you're out language. Other controversial provisions on statutory damages and anti-camcording rules were made optional rather than mandatory.
While the Internet provisions may not be as bad as SOPA, the remainder of the agreement raises many significant concerns.
For example Section 3 of ACTA deals with the flow of infringing products across borders. It requires countries to allow customs officials to seize goods suspected of infringement. Such seizures would be allowed not only in the origin and destination nations, but also while the goods are in transit through third countries.
This provision can be used against cou ntries such as India which manufactured generaic drugs, and export to various countries. Patent claims on medical inventions are not actually recognised in Indian courts. But however if India signed ACTA even without any parliament approval or law in this country India will be forced to ban such drugs, and only import the patentslayered highest cost USA drugs. This is the reason why india is fighting ACTA. But If USA and EU sign such deal, this countries even sizures the shipment of such drug in another countries or in mid sea and and heavy punishment such as prision term can be imposed.
Another BAD provision are these Agreements are bypassed local parliaments of the country and simply a executives agreement. So even without law or parliament approval, if manmohan or his representative signed, india will be directly under USA and EU axis control.
Countries such as India have expressed concern that it conflicts with the TRIPS Agreement. Other elements of the agreement increase the standards in the WIPO Internet Treaties and the commercial scale definition at the WTO. The agreement adds new criminal provisions, pressures ISPs to take greater action, and heightens border measures. There remains ongoing debate as to whether the substance of ACTA requires legislative change in many signatory countries

Polish Prime Minister Donald Tusk has announced the country is suspending its ratification of the Anti-Counterfeiting Trade Agreement. The announcement comes following huge protests in cities across the country.

What it is meaning is, Even in USA the Executive Branch (the president) will bypass the Congress and Senate, or even Supreme court, to implement ACTA so it will not be questioned in any court of law...the pattern is not simply in one country.. but spread to many wealthy countries, where executive branches are available to highest bidders, and the industries hunchoes try to establish their own empires, by suppressing the Will of the people.. So remember you are not alone.. your children may not even know what is freedom or democracy is.."more dangerous than SOPA." He added, "It’s not coming to me for a vote. It purports that it does not change existing laws. But once implemented, it creates a whole new enforcement system and will virtually tie the hands of Congress to undo it."
